Berkeley Police Department Jail Facility
The Berkeley Police Department's jail facility is located inside the Ronald T. Tsukamoto Public Safety Building at 2100 Martin Luther King Jr. Way. The Jail is administered by the following chain of command (in descending order): Chief of Police, Professional Standards Division Captain, Professional Standards Division Lieutenant, Jail Operations Sergeant and Jail/CSO Supervisor/supervisor designee. The jail is staffed by one Sergeant and 15 Community Services Officers (CSOs) and is part of the Professional Standards Division.
The jail has a total of 16 cells for men and four (4) cells for women, two (2) Detoxification cells and two (2) Safety cells. The facility can house 40 detainees and is used for incarceration between arrest and arraignment, normally the next business day, or pending court holidays or within 48 hours. Visiting an individual in the BPD Jail Facility is allowed between 1:00 p.m. and 3:00 p.m. Saturday, Sunday and Holidays; or between 4:30 p.m. and 6:00 p.m. during the detainee's second calendar weekday in custody. Visitors must be 18 years or older and have valid identification and no children are allowed in the visiting rooms. Attorneys with an active Bar Card may visit their clients at any hour, provided that the staff can accommodate their request. An attorney granted a “contact visit” with his/her client is not exempt from a thorough cursory and/or metal detector search of their person and belongings.
There is no longer a Berkeley/Albany Municipal Courthouse in the City Of Berkeley. All court arraignments are held at 9:00 a.m. and 2:00 p.m., Monday through Friday (except court holidays), at the Wiley W. Manuel Superior Court, 661 Washington, Oakland.
Information concerning a prisoner's intake in the jail facility, including booking, medical information and property records, will remain on file for at least three (3) years. Property left unclaimed in the jail facility for more than 90 days is subject to destruction in accordance with the current state law.
The Berkeley City Jail registers Arson (PC 457.1), Sex (PC 290) and Drug (HS 11590) registrants to meet their legal restrictions and remain in compliance with their sentencing. In order to completely process the paperwork for registrants, documents demonstrating current address and current vehicle registration information must be brought in. All persons entering the Jail facility shall be subject to a thorough cursory and/or metal detector search of their person and belongings.
"By law, persons convicted of specified sex crimes are required to register as sex offenders with a local law enforcement agency. Prior to release from prison, jail, a mental hospital, or on probation, sex offenders are notified in writing of their duty to register, and a copy of the notification form is forwarded to DOJ. When a sex offender is released into the community, the agency forwards the registration information to DOJ.
Registered sex offenders are required to update their information annually, within five working days of their birthday. Some sex offenders must update more often: transients must update every 30 days, and sexually violent predators, every 90 days. The Sex Offender Tracking Program keeps track of the next required update, and if a registered sex offender is in violation of the update requirements, the Internet web site will show the registrant as being in violation.
When registrants change their residence address or become homeless (transient), they are required to update their registration information within five days with a local agency, which forwards that information to DOJ. DOJ updates the registered sex offender database on a daily basis, based on information received from local agencies. DOJ also updates the registered sex offender information on this Internet web site on a daily basis."
