Item 5.a.(1) Authorization for the Board's Legal Department to file a brief in the California Supreme Court as Amicus Curiae in support of Defendant and Appellant Syriah Degrate in Wasatch Property Management v. Degrate, Supreme Court No. S112386. M/S/C (Siegel/Hogarth) AUTHORIZATION GRANTED. Roll call vote. Passed unanimously.
Item 5.a.(2) Proposal that the Board adopt a resolution requesting the City Council to amend Berkeley Municipal Code Section 13.77.050 to include the notice requirement in Government Code section 7060.4(b)(4) and (5) for extending the date of withdrawal from the market units occupied by non-elderly and non-disabled tenants. Commissioner Siegel recused himself. M/S/C (Alberti/Evans) TO ADOPT RESOLUTION AS WRITTEN. Roll call vote. Item 5.a.(3) Proposal that the Board adopt a resolution authorizing the Executive Director to modify the Rent Board's contract with the Eviction Defense Center to increase the total amount payable under the contract in Fiscal Year 2002/2003 by $2,300.
