Item 1. Call to Order of Closed Session - Chair Max Anderson called the meeting to order at 7:03 p.m.

Call to Order of Regular Meeting - Chair Anderson called the regular meeting to order at 7:28 p.m.

Item 2. Closed Session

The Rent Board met in closed session pursuant to Government Code Section 54956.9(a) to confer with legal counsel regarding the following existing litigation: 

King v. City of Berkeley Rent Stabilization Board (Dai), Alameda County Superior Court No. 2001-035396.

Item 3. Approval of the Agenda - M/S/C (Spector/Alberti) TO CONTINUE APPEAL IN T-4236 TO SEPTEMBER 15, 2003 REGULAR BOARD MEETING AND OTHERWISE APPROVE AS WRITTEN. Voice vote. Passed: 7-0-0-2. Absent: Kavanagh, Payne.

Item 4. Public Forum - There were no speakers.

Item 5. Approval of the August 18, 2003 Minutes - M/S/C (Evans/Siegel). APPROVED AS WRITTEN. Voice vote. Passed: 7-0-0-2. Absent: Kavanagh, Payne.

Item 6.a. Appeal T-4200 - 1705 - 62nd Street - M/S/C (Chong/Alberti) TO ACCEPT LEGAL STAFF RECOMMENDATION AND AFFIRM THE DECISION OF HEARING EXAMINER. Roll call vote. Yes: Alberti, Anderson, Chong, Hogarth, Siegel; No: None; Abstain: Evans, Spector; Absent: Kavanagh, Payne. Passed: 5-0-2-2.

Item 7.a.(1) That the Board adopt a resolution approving a revised Records Retention Schedule in compliance with the City Records Management Program. M/S/C (Siegel/Hogarth) TO ADOPT THE RESOLUTION AS WRITTEN. Roll call vote. Yes: Alberti, Anderson, Chong, Evans, Hogarth, Siegel, Spector; No: None; Abstain: None; Absent: Kavanagh, Payne. Passed: 7-0-0-2.

Item 7.a.(2) That the Board adopt second reading of proposal to repeal Regulation 1239 to eliminate the requirement that the amount of a rent adjustment granted not exceed the amount requested in the rent adjustment petition. M/S/C (Siegel/Hogarth) TO ADOPT SECOND READING TO REPEAL REGULATION 1239. Roll call vote. Yes: Alberti, Anderson, Chong, Evans, Hogarth, Siegel, Spector; No: None; Abstain: None; Absent: Kavanagh, Payne. Passed: 7-0-0-2.

Item 7.a.(3) That the Board adopt a resolution authorizing the Executive Director to extend the agreement with the City of Berkeley Housing Department whereby the Board will pay the Housing Department no more than $10,000 in the 2003/04 fiscal year to continue to monitor the contract compliance of the Board's community agency service providers. M/S/C (Hogarth/Alberti) TO AUTHORIZE EXECUTIVE DIRECTOR TO EXTEND THE AGREEMENT WITH THE CITY OF BERKELEY HOUSING DEPARTMENT. Roll call vote.
