6. Appeals - Time Certain - 7:30PM
a. Appeal T-4160/T-4161; 2126 Bancroft Way. This is a landlord appeal of a hearing examiner decision that awarded significant rent refunds for habitability problems. On appeal, the landlord claims that the tenants exaggerated the duration of the various problems. However, no evidence is cited or argument presented to support this claim. For this reason, it is recommended that the decision of the hearing examiner be affirmed.
b. Appeal L-3688/T-4104; 2398 Hilgard Ave. (Continued from September 5, 2002 meeting.) The landlord filed a petition for a determination of the rent reductions that would be imposed if certain housing services were removed from the unit. The hearing examiner issued a decision which has been appealed by the tenant. The tenant, however, no longer resides in the subject unit and a new rent has been established for the current tenant. Therefore, the issue of rent reductions for the removal of services from the new former tenant is moot. A decision on the appeal, other than a dismissal, will have no practical significance.
