Item 7.a.(1) Second reading of proposal to amend Regulation 1271 to clarify that rent overcharges resulting from a failure to return interest earned on security deposits are not subject to the three-year statute of limitations. M/S/C (Hogarth/Harris) TO ADOPT PROPOSAL TO AMEND REGULATION 1271. A roll call vote was taken. Yes: Maldonado, Anderson, Spector, Harris, Siegel, Hogarth; No: None; Abstain: None; Absent: Janowitz, Bernay, Alberti. Passed: 6-0-0-3.

Item 7.a.(2) Second reading of proposal to amend Regulation 1013 to conform to recent amendment to Civil Code Section 1954.52 (Costa-Hawkins) enacted by SB 985 that restricts the exemption for condominium units to only such units that have been sold separately by the subdivider to a bona fide purchaser for value. M/S/C (Hogarth/Harris) TO ADOPT PROPOSAL TO AMEND REGULATION 1013. A roll call vote was taken. Yes: Maldonado, Anderson, Spector, Harris, Siegel, Hogarth; No: None; Abstain: None; Absent: Janowitz, Bernay, Alberti. Passed: 6-0-0-3.

Item 4. Public Hearing to determine the fee to be collected from owners who remove property from the rental housing market under Ellis Act (Gov't Code section7060 et seq.) M/S/C (Hogarth/Harris) MOTION TO OPEN PUBLIC HEARING. 7:15PM Commissioner Siegel recused himself. Voice vote. Passed: 5-0-0-3-1 Absent: Janowitz, Bernay, Alberti; Recused: Siegel.

Item 4.d. Adoption of Resolution 02-01 revising the Rent Stabilization Program's fee schedule to update the schedule to include Ellis Act administration fees. M/S/C (Harris/Spector) THE FEE TO THE OWNER FOR ADMINISTERING THE ELLIS ACT IS $300 FOR THE FIRST TWO UNITS AND $100 FOR EACH ADDITIONAL OCCUPIED UNIT ON A PROPERTY. A roll call vote was taken. Yes: Maldonado, Anderson, Spector, Harris, Hogarth; No: None; Abstain: None; Absent: Janowitz, Bernay, Alberti; Recused: Siegel. Passed: 6-0-0-3.
