Item 6.a.(1) First reading of proposed amendment to Regulation 1013 to provide that the occupancy of a rental unit by a landlord's relative following recovery of possession of the unit pursuant to B.M.C. section 13.76.130.A.9b is not a tenancy for purposes of establishing an initial rent for the first tenancy following termination of the relative's occupancy. A roll call vote was taken. Yes: Maldonado, Spector; No: Janowitz, Anderson, Bernay, Siegel, Hogarth, Alberti; Abstain: None; Absent: Harris. Failed: 2-6-0-1. M/S/C (Bernay/Anderson) UPHOLD SECTION 4 OF LEGAL STAFF'S RECOMMENDATION TO MODIFY HEARING EXAMINER'S DECISION TO EXCLUDE POST HEARING EVIDENCE AND TO CONFORM TO THE ESTRADA CASE. A friendly amendment was made by Commissioner Hogarth and accepted.
