Recommendation that Board adopt a resolution in appreciation of Sandra Pardo's outstanding outreach and counseling service to the tenants and landlords in the Berkeley community during her employment as a Community Services Specialist for the Berkeley Rent Stabilization Board. Item 7.b. Appeal T-4076 - 1721 Martin Luther King Jr. Way, #3. (Continued from June 3, 2002 meeting). M/S/C (Spector/Siegel) REMAND TO HEARING EXAMINER WITH THE FOLLOWING FINDINGS AND INSTRUCTIONS: (1) The 1980 base rent for apartments 1 and 3 shall be based on the RTS business record; (2) the analysis by Legal staff in its recommendation to the Board on the Doctrine of Equitable Estoppel shall not be applied; and (3) on remand the Hearing Examiner, through this T petition, will take evidence to set the current legal rent for what is now apartment 3, taking into consideration apartment 3 is not the same as apartment 3 in 1980, in that it is now combined with apartment 1. First reading of proposed amendment to Subsection (B)(3) of Regulation 1269 to provide that the minimum rent decrease for a rental unit that substantially lacks the affirmative characteristics of subdivisions (b) [plumbing/gas facilities], (c) [hot/cold running water] and (d) [adequate heating facilities] of Civil Code section 1941.1 shall be 20%.
