Item 2. Approval of the Agenda . APPROVED AS WRITTEN. M/S/C (Siegel/Alberti) Passed 7-0-0-2. Absent: Janowitz, Harris.

Item 3. Public Forum.  There were three speakers. Peggy Schioler and Lance Altehes spoke during the time for public forum. Melanie Welch came after the time for public forum had closed, but was granted the opportunity to address the Board following the appeal hearing.

Item 4. Special Order of Business. Report on community outreach activities by Rent Stabilization Board Public Information Unit Community Service Specalists, Sandra Pardo and Laurie Wonnell. No action taken.

Item 5. Approval of the Minutes . APPROVED AS WRITTEN. M/S/C (Siegel/Bernay) Passed 9-0-0-0.

Item 6. Appeals in L-3585 and T-3818 - 1416 9th Street C and D.

M/S/C (Siegel/Alberti) TO ALLOW BOTH PARTIES FIVE ADDITIONAL MINUTES TO SPEAK IN ADDITION TO THE FIVE MINUTE SPEAKING TIME ALLOWED AT THE FIRST HEARING ON FEBRUARY 5, 2001. Passed 9-0-0-0

M/S (Harris/Anderson) TO AFFIRM LEGAL STAFF'S RECOMMENDATION.

The following substitute motion was made: M/S/C (Janowitz/Hogarth) TO ADOPT LEGAL STAFF RECOMMENDATION WITH AN AMENDMENT TO CHANGE THE $20 REPLACEMENT VALUE FOR LOSS OF SERVICES TO $80. A roll call vote of the substitute motion was taken. Yes: Maldonado, Janowitz, Anderson, Siegel, Hogarth; No: Bernay, Spector, Harris, Alberti; Abstain: None; Absent: None. Passed 5-4-0-0.

Item 7.a. First reading of proposal to amend Regulation 1206 to increase the statute of limitations for former tenants to file petitions with the Board from one year to three years. M/S/C (Siegel/Spector) TO ADOPT PROPOSAL TO AMEND REGULATION 1206. A roll call vote was taken. Yes: Maldonado, Janowitz, Anderson, Bernay, Spector, Harris, Siegel, Hogarth, Alberti. Passed 9-0-0-0.

Item 7.b. Proposal to approve staff recommendations on the following requests for waiver of late registration penalties:

Waivers 2522, 2551, 2556, 2572, 2574. M/S/C (Alberti/Janowitz) TO UPHOLD HEARING EXAMINER'S RECOMMENDATION. Passed 9-0-0-0.

Waiver 2547. M/S/C (Bernay/Hogarth) TO UPHOLD HEARING EXAMINER'S RECOMMENDATION. A roll call vote was taken. Maldonado passed; Yes: Anderson, Bernay, Harris, Hogarth, Alberti; No: Siegel; Abstain: Janowitz, Spector. Passed 5-1-2-0 1 (pass).

Waiver 2550. M/S/C (Siegel/Hogarth) TO WAIVE ALL PENALTIES. A roll call vote was taken. Yes: Maldonado, Janowitz, Anderson, Siegel, Hogarth; No: Bernay, Spector, Harris, Alberti; Abstain: None; Absent: None. Passed 5-4-0-0.

Waivers 2554, 2559. M/S/C (Bernay/Hogarth) TO REDUCE THE WAIVER TO 50% OF THE TOTAL PENALTIES INSTEAD OF 70%. A roll call vote was taken. Yes: Maldonado, Janowitz, Anderson, Bernay, Spector, Hogarth, Alberti; No: Harris, Siegel; Abstain: None; Absent: None. Passed 7-2-0-0.

Waiver 2555. M/S/C (Bernay/Hogarth) TO UPHOLD HEARING EXAMINER'S RECOMMENDATION. A roll call vote was taken. Yes: Janowitz, Anderson, Bernay, Spector, Harris, Hogarth; No: Siegel; Abstain: Maldonado, Alberti; Absent: None. Passed 6-1-2-0.

Waiver 2560. M/S (Alberti/Bernay) TO REDUCE THE WAIVER BY 50%. The following substitute motion was made: M/S/C (Maldonado/Spector) TO UPHOLD HEARING EXAMINER'S RECOMMENDATION. A roll call vote of the substitute motion was taken. Yes: Maldonado, Janowitz, Anderson, Spector, Harris, Siegel, Alberti; No: Bernay, Hogarth; Abstain: None; Absent: None. Passed 7-2-0-0.

Waiver 2569. M/S/C (Hogarth/Alberti) TO AMEND HEARING EXAMINER'S RECOMMENDATION TO WAIVE PENALTIES BY 50% INSTEAD OF 80%. A roll call vote was taken. Yes: Maldonado, Janowitz, Bernay, Spector, Harris, Siegel, Hogarth, Alberti; No: None; Abstain: Anderson; Absent: None. Passed 8-0-1-0.
