5. Appeal Time Certain – 7:15 p.m.

a.  Appeal T-4917.   This is an appeal of a hearing examiner’s decision that awarded rent overcharges due to habitability problems in the tenant’s unit.  Although not raised in the petition, the hearing examiner offered an opinion on how the utility provision in the tenant’s lease was likely to be interpreted.  On appeal, the landlord argues that the opinion is contrary to the law.  The opinion rendered by the hearing examiner, however, is not binding on the parties and, therefore, does not present an appealable issue.  Regarding the rent overcharge award, the landlord cites no facts and presents no argument that would warrant modification of the hearing examiner’s decision.  For these reasons, staff recommends that the decision of the hearing examiner be affirmed.
