BERKELEY CITY COUNCIL SPECIAL MEETING

TUESDAY, October 28, 2008

Preliminary Matters

Roll Call            5:04 p.m. 

Present:        Councilmembers Maio, Moore, Anderson, Capitelli, Olds, Wozniak, and Mayor Bates. 

Absent:            Worthington.

Public Comment - Limited to items on this agenda only - 0

CLOSED SESSION:

The City Council and Police Review Commission will recess into closed session to meet with its attorneys concerning the following matter:

BERKELEY CITY COUNCIL AND POLICE REVIEW COMMISSION

JOINT SPECIAL MEETING

 

1.  CONFERENCE WITH LEGAL COUNSEL – EXISTING LITIGATION PURSUANT TO GOVERNMENT CODE SECTION 54956.9(a):

Berkeley Police Association v. City of Berkeley, et al., California Court of Appeals Case Nos. A118537 and A119758; Alameda County Superior Court Case No. 2002 057569,

The Police Review Commission meeting will adjourn and the City Council will continue in closed session to discuss each of the following matters, not necessarily in the order listed below:

 

Action: M/S/C (Olds/Maio) to direct the City Attorney to not pursue California Court of Appeals Case No. A118537.  Vote: Ayes: Maio, Moore, Capitelli, Olds, Wozniak, Bates.  Abstain: Anderson. Absent: Worthington.

 

Action: M/S/C (Capitelli/Wozniak) to direct the City Attorney to not pursue California Court of Appeals Case No A119758.  Vote: Ayes: Maio, Moore, Capitelli, Olds, Wozniak, Bates.  Abstain: Anderson. Absent: Worthington.

 

BERKELEY CITY COUNCIL SPECIAL MEETING

The City Council recess into closed session to meet with its attorneys concerning the following matters:

2.  CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION PURSUANT `TO GOVERNMENT CODE SECTION 54956.9(a):

Kungu-Crawford v. City of Berkeley

Alameda County Superior Court Action No. RG 07 334769.  .

 

Action: M/S/C (Maio/Moore) to adopt Resolution No. 64,246–N.S. to move forward with the settlement agreement in the case of Kungu-Crawford v. City of Berkeley.

3.  CONFERENCE WITH REAL PROPERTY NEGOTIATORS PURSUANT TO GOVERNMENT CODE SECTION 54956.8:
