5. Appeal Time Certain – 7:15 p.m.

a.  Appeal T-5105, 2253 Ward Street.  This is an appeal by a landlord of a hearing examiner decision that awarded a refund of the tenant’s entire security deposit plus interest.  The Landlord Appellant did not appear at the hearing on this matter.  On appeal, Appellant claims that the tenant is not entitled to a refund of her deposit and that Appellant was not informed of the hearing date.  Appellant raises new arguments on appeal that were not part of the original record before the hearing examiner and should therefore not be considered.  Upon review of the record, it appears that the hearing examiner correctly ruled that the tenant was entitled to a refund of her entire security deposit with interest.  For these reasons, staff recommends that the decision of the hearing examiner be affirmed.

b.  Appeal IRD-26, 2618 Hillegass Avenue.  This is an appeal by a tenant of a hearing examiner decision that allowed a landlord to establish an initial rent for the current tenancy.  On appeal, the tenant claims that the house is a rooming house (what the tenant refers to as a “boarding house”) and that Premium Properties is not in compliance with the fictitious business name law and thus not entitled to serve a rent increase notice in this case.  Appellant raises new arguments on appeal that were not part of the original record before the hearing examiner and should therefore not be considered.  Upon review of the record, it appears that the hearing examiner correctly ruled that the landlord was entitled to set a new rent for the current tenancy.  For these reasons, staff recommends that the decision of the hearing examiner be affirmed.

6. Action Items

(1) Second Reading of proposed amendments to Regulation 1234 [Rights of Parties] to include a requirement that a party specifically designate a representative before the representative is able to represent the party (Chair Stephens) 

(2)Discussion and possible action on proposal by Councilmember Arreguin on legislation concerning tenant application screening fees (Chair Stephens) 

(3) Recommendation that the Board endorse two measures placed on the November ballot by the Berkeley School Board continuing the existing tax and authorizing issuance of new bonds to improve school safety and facilities for learning and teaching (Chair Stephens)

(4) Proposal that the Board endorse the recommendations of Councilmembers Capitelli and Arreguin regarding Phase Two of the Soft Story retrofit program and enforcement of Phase One, to be presented at the City Council meeting of September 21, 2010 (Safe and Sustainable Housing Committee) 

(5) Proposal to approve staff recommendation on the following requests for waiver of late registration penalties  (Executive Director)
