1. Amendments to West Berkeley Plan and Zoning Requirements (Continued from February 8, 2011) (PDF)

Recommendation: Hear additional public testimony, close the public hearing and direct staff to return with appropriate CEQA findings and ordinances to adopt the proposed modifications to the Zoning Ordinance and the West Berkeley Plan.    Changes proposed in zoning ordinance sections BMC 23B.36, 23E.28, 23E.72, 23E.76, 23E.80, and 23F.04 and to the West Berkeley Plan, Section 1.Land Use, Subsection VII Land Use Regulations of the West Berkeley Plan – For Adoption in Principle, pages 42 ff.

Action: M/S/C (Capitelli/Wengraf) to suspend the Council Rules of Procedure and extend the meeting to 11:30 p.m.

Vote: Ayes - Maio, Moore, Capitelli, Wengraf, Wozniak, Bates. Noes - Anderson, Arreguin, Worthington.

Action: M/S/C (Wengraf/Wozniak) to approve the following staff language:

I.  Zoning language to implement alternatives:

A.  Converting warehouse/wholesale space:  In the MM and MU-LI zoning districts, insert the following Paragraph E:

“E. The City Manager shall report to the City Council within 30 days after 100,000 gross square feet of protected warehouse and wholesale space in the MM and MULI zoning districts has been converted from warehouse or wholesale use to research and development use.

Vote: Ayes - Moore, Capitelli, Wengraf, Wozniak, Bates.  Noes - Maio, Anderson, Arreguin, Worthington. 

Action: M/S/C (Bates/Wozniak) to direct staff provide language for Council action on March 22, 2011 for the following changes to for the West Berkeley Plan and zoning districts as recommended by the Planning Commission:

That staff return with applicable amendments to the zoning ordinance and West Berkeley Plan for the selected zoning changes, language necessary to certify the West Berkeley Project EIR, and any other required documentation necessary for these actions.

Continue the discussion of the protected use of warehouse and wholesale space in the MM and MU-LI Districts and the Master Use Permit regulations (including parts B,C,D and E from the staff report) to the March 22, 2011 Council meeting.

Vote: Ayes - Maio, Moore, Anderson, Capitelli, Wengraf, Wozniak, Bates.  Noes - Arreguin, Worthington.
