      Appeal T-5128 (2919 Hillegass Avenue, Unit #C)

Tenant appeals a hearing examiner decision ordering the landlord to refund a total of $666.87 to tenant for rent overcharges related to habitability violations and decreases in services.  On appeal, the tenant argues that he was justified in denying access to the landlord to complete necessary repairs to the rental unit and that the hearing examiner should have awarded a rent reduction due to the deteriorated condition of the kitchen walls.  A review of the record establishes that the hearing examiner correctly ruled on the issue of the tenant’s denial of access to the unit to make repairs but should have granted the tenant a reduction for the condition of the kitchen walls.  For this reason, legal staff recommends that the Board adjust the total rent overcharges due the tenant by granting a reduction for the condition of the kitchen walls.
