1257. Enforcement of Escrow Orders

(A) In the event that anescrow account has been ordered pending the decision of the Hearing Examiner, upon the failure of a party to comply with any order regarding the deposit of funds into escrow, the petition shall be dismissed without prejudice if the noncomplying party is the petitioner or, if the noncomplying party is the respondent, the response shall be struck and the petition decided upon its merits.

(B) In the event that an escrow account has been ordered pending appeal, upon the failure of a party to comply with any order regarding the deposit of fund into escrow, the appeal shall be dismissed with prejudice if the noncomplying party is the appellant, or, if the noncomplying party is the appellee, the response shall be struck and the appeal decided upon its merits.
