At its regular meeting on October 18, 2004, the Berkeley Rent Stabilization Board adopted the Annual General Adjustment (AGA) Order for 2005 authorizing eligible landlords to increase the 2004 permanent rent ceilings of rental units covered by the Rent Stabilization Ordinance by 0.9%, except those rental units for which an Initial Rent was established pursuant to the Costa-Hawkins Rental Housing Act on or after January 1, 2004. The 0.9% increase will become effective on January 1, 2005. The Order sets forth the conditions for qualifying for this rent increase and the notice that must be given to tenants in order to raise the rent.
