Comments From The Public:  A total of thirty (30) minutes is scheduled.  Each speaker is limited to a maximum of three (3) minutes.

 Consent Calendar

The Council will consider removal and addition of items to the Consent Calendar prior to voting on the Consent Calendar.   All items remaining on the Consent Calendar will be approved in one motion.  Items removed from the Consent Calendar will be taken up after the “Action Calendar” unless the Council reorders the agenda.
 1.       Waiver of Fees for Peoples' Park 31st Anniversary
            From:  Councilmember Worthington
            Recommendation:  Waive all fees, including fees for event, food, sound permits, and insurance fees associated with the Peoples' Park 31st Anniversary Street Fair and Concert on Sunday, April 30th and allow an exemption to Berkeley Municipal Code (BMC) Section 20.24.040, allowing a banner to be hung across Telegraph Avenue advertising this event.  Also, approve the City's provision of the following in-kind services for the People's Park 31st Anniversary:  4 portable toilets provided by Public Works, assistance from Public Works in hanging of banners, dumpster and solid waste services, and traffic signage and traffic engineering for the closure of Telegraph (between Dwight and Channing) and Haste (between Bowditch and Dana).

2.         Aquatic Park Sound Barrier Project
            From:  City Manager
            Recommendation:  1) Allow for the time needed to reach agreement between the City and Caltrans on the design of the Aquatic Park Sound Barrier and endorse an October 1, 2000 deadline for agreement as outlined by the Alameda County Congestion Management Authority (CMA) that would initiate a fiscal year 2001/2002 design process (beginning in July 2001) with  construction funds available July 2002; 2) allow the $3.5 million programmed budget for the Aquatic Parks Sound Barrier in the current fiscal year in State Transportation Improvement Program (STIP) to lapse to be reprogrammed in the 2002 STIP to create adequate time for the City and Caltrans, with the assistance of an independent engineering firm, to redesign the wall to the satisfaction of both parties; 3) request of the California Transportation Commission (CTC) that it authorize the necessary supplemental design support funding (separate from budgeted construction funding) needed for Caltrans to design the sound barrier; 4) allocate adequate funding (estimated up to $55,000) to cover staff and consultant time to track and participate in Caltrans' design and cost modification for the project.  Included in this would be a 50% contribution ($10,000) from the City of Berkeley to the CMA as part of anticipated $20,000 cost for independent engineer firm hired by the CMA; 5) commit to securing, if necessary, supplementary funds to ensure a minimum 3,100 ft. modified Living Wall project is constructed, provided the City is satisfied that the most cost-effective design has been developed by Caltrans and the supplemental funding does not exceed 15% of the project construction budget.  Note:  $531,000 is 15% of $3.4M budgeted amount (approved April 11, 2000); 6)  support efforts to identify supplemental funding for the project to extend beyond the minimum 3,100 ft.  Note:  the City's preferred length is 5,600 ft. for full sound attenuation in the park (approved April 11,200);  7) the Council will work closely with its legislative delegates in its dealings with Caltrans (approved April 11,2000).

3.     Reconsideration of Schedule for FY 2001 Budget Public Hearing
        From:  Councilmember Spring
        Recommendation:  Discuss and take action on rescheduling the public hearing on the City's FY2001 budget previously set for May 16, due to conflicts with other public hearings scheduled for that night.
