Preliminary Matters

 

Roll Call:  7:00 p.m.

 

Comments from the City Manager : The City Manager may make announcements or provide information to the City Council in the form of an oral report. The Council will not take action on such items, but may request the City Manager place a report on a future agenda for discussion and/or action.

 

Comments from the Public:  A total of thirty (30) minutes is scheduled. Each speaker is limited to a maximum of three (3) minutes.

 

Council Action:  The City Council may take action related to any subject listed on the Agenda. 

 

 

  Consent Calendar

The Council will consider removal and addition of items to the Consent Calendar prior to voting on the Consent Calendar. All items remaining on the Consent Calendar will be approved in one motion.  Items removed from the Consent Calendar will be held over to the next meeting unless the City Manager requests action due to priority.

 

1.         Needle Exchange Emergency Distribution

From:  City Manager

Recommendation: Adopt a Resolution reviewing and confirming the continued existence of a local emergency with regard to HIV transmission from use of HIV-infected needles among injection drug users, and authorizing the Local Health Officer to take steps to enable the operation of needle exchange emergency distribution.

2.         Business Improvement District Ordinance (first reading vote 2/20 - unanimous)

            From:  City Manager

            Recommendation:  Adopt second reading of an Ordinance establishing supplemental authorization for the formation of property and business improvement districts under the Property and Business Improvement Act of 1994.

3.         South Berkeley Revolving Loan Fund

            From:  City Manager

            Recommendation:  Adopt a Resolution endorsing the South Berkeley Revolving Loan Fund (RLF) Plan Certification as required by the federal Economic Development Administration (EDA).

4.         Contract:  Alta Bates Medical Center Development Application

            From:  City Manager

Recommendation:  Adopt a Resolution authorizing the City Manager to execute a sole source contract and any amendments in an amount not to exceed $20,000 with Chandler W. Lee to continue providing management assistance in review of the Alta Bates Medical Center development application.

5.         Agreement:  Gabe Catalfo Fields and Field House at Harrison Park

            From:  City Manager

Recommendation:  Adopt a Resolution authorizing the City Manager to execute an agreement and any amendments with the Association for Sport Field Users to maintain the Gabe Catalfo Fields and the field house located at Harrison Park.

6.         Grant:  Virginia-McGee Tot Land

            From:  City Manager

Recommendation:  Adopt a Resolution authorizing the City Manager to submit a FY00/01 grant application for $50,000 to the State of California Integrated Waste Management Board (CIWMB) for park playground accessibility upgrades at Virginia-McGee Tot Land and authorize the City Manager to enter into any subsequent grant agreement with CIWMB for the Virginia McGee Tot Land grant.

7.         Contract:  Aquatic Park Site Preparation Project

            From:  City Manager

Recommendation:  Adopt a Resolution authorizing the City Manager to execute a contract amendment and any future amendments for BRCO Constructors, Inc., increasing the total contract amount by $16,966, for a total contract amount not to exceed $198,595, for the Aquatic Park Site Preparation Project.

8.         Grant Agreement:  Robert Leathers Play Area at Aquatic Park

            From:  City Manager

Recommendation:  Adopt a Resolution authorizing the City Manager to execute an amendment to the grant agreement with Berkeley Partners for Parks (BPFP) to increase the contract amount by $55,404 for a total not to exceed amount $177,404 for the purchase and installation of the Robert Leathers Play Area at Aquatic Park.

9.         Lease Agreement at 2201 Dwight Way

            From:  City Manager

Recommendation:  Adopt a Resolution approving the expenditure of $200,000 for termination of the lease agreement at 2201 Dwight Way.

10.       Safety Members Pension Fund Audit

            From:  City Auditor

Recommendation:  1) Accept the Safety Members Pension Fund audit report for fiscal year ending June 30, 2000; and 2) request the City Manager report on implementation of the audit recommendations at the April 24, 2001 Council meeting.

11.       Raising the Tibetan Flag in Solidarity with the Tibetan People

            From:  Councilmember Worthington

Recommendation:  Authorize the Tibetan flag to be raised on the City flag pole on March 10, 2001 to show solidarity with the people of Tibet and Tibetan support groups in commemoration of the Tibetan National Uprising.

12.       Funding Request for Ecumenical Chaplaincy to the Homeless

Recommendation:  Refer to the City Manager the request for immediate funding of $25,000 for the Berkeley Ecumenical Chaplaincy to the Homeless.

13.       Berkeley Cougars Youth Football and Cheerleader Program

            From:  Councilmember Breland

Recommendation:  Refer $20,000 to the budget process for Berkeley Cougars Youth Football and Cheerleader Program for its 2001 season.

14.       Council Liaison Appointments

            From:  Mayor Dean

Recommendation:  1) Adopt a Resolution designating Vice Mayor Maudelle Shirek as Council liaison to the Library Board of Trustees for a term ending with the expiration of her term of election to the Council and to the Mental Health Commission for a term ending November 30, 2002; 2) Adopt a Resolution designating Councilmember Margaret Breland as Council liaison to the Community Health Commission for a term ending November 30, 2002; and 3) rescind all past resolutions regarding these appointments.

15.       Budget Referral:  2001 Junior Wheelchair Games in Brisbane, Australia

            Recommendation:  Refer $1,000 to the budget process to support Lamile Perry's quest to participate in the 2001 Junior Wheelchair Games in Brisbane, Australia.

16.       Policies for Playing Field Planning Process (CR# 69-00)

Recommendation:  Maintain the existing practice of having staff continue to explore potential site proposals for expanded recreational use and continue involving citizens in the review process as soon as staff believes a proposal has a chance of becoming a project.

17.       Companion Animals Ordinance Change to "Owner/Guardian"

            Recommendation:  Direct the City Attorney to draft an ordinance revising Title 10 of the Berkeley Municipal Code (BMC) to change the term "owner" to "owner/guardian" in all references to companion animals.

18.       Survey of Telecommunications Needs

            Recommendation:  Adopt a Resolution authorizing the City Council to allocate $20,000 to obtain professional quality survey of telecommunication needs of businesses and related institutions (training sites and institutes, distance teaching programs, hospitals, etc.) in Berkeley to be used in the Master Plan for Telecommunications due to Council in June 2001.

            Recommendation:  Request was reviewed by Council on February 13 as part of the mid-year budget request process.  Council decided not to include the request in the list of approved mid-year budget items.  Request to be considered with all other remaining mid-year budget requests during the March 2001 Council priority-setting sessions.

19.       IFEU Workshop (held over from 2/20)

Recommendation:  Amend action of October 24, 2000 on the IFEU contract:  1) cancel the community workshop on the IFEU report proposed for April 2, 2001; and 2) schedule just one presentation by IFEU and that it be before the City Council at the already scheduled time 5:30 p.m. on March 27, 2001 in the Council Chambers.

22.       Vacation of a Portion of Carleton Street

Recommendation:  Conduct a public hearing and upon conclusion, adopt first reading of an Ordinance vacating a portion of the public right-of-way of Carleton Street from its westerly terminus at the Union Pacific railroad right-of-way extending 592.41 feet easterly and authorizing the City Manager to accept a deed for real property and execute a quit claim deed.

23.       Extension of Moratorium for Shops Selling Tobacco Products

Recommendation:  Conduct a public hearing and upon conclusion 1) adopt an Urgency Interim Ordinance extending the existing moratorium on the establishment or expansion of retail businesses devoted primarily to the sale of tobacco and tobacco products for ten months and 15 days; and 2) direct the City Manager to propose zoning amendments to protect public health and promote compliance with State laws prohibiting the sales of tobacco products to minors.

24.       Extend Residential Permit Parking

Recommendation:  Conduct a public hearing and upon conclusion, adopt a Resolution amending Section 25N of Resolution No. 56,508-N.S., to extend residential permit parking on both sides of Hearst Avenue between Acton Street and Franklin Street and authorizing the use of $300 to cover implementation.
