Preliminary Matters

 

Roll Call:  7:00 p.m.

 

Comments from the City Manager: The City Manager may make announcements or provide information to the City Council in the form of an oral report. The Council will not take action on such items, but may request the City Manager place a report on a future agenda for discussion

and/or action.

 

Comments from the Public:  A total of thirty (30) minutes is scheduled. Each speaker is limited to a maximum of three (3) minutes.

 

Council Action:  The City Council may take action related to any subject listed on the Agenda. 

 

 

Consent Calendar
The Council will consider removal and addition of items to the Consent Calendar prior to voting on the Consent Calendar. All items remaining on the Consent Calendar will be approved in one motion.  Items removed from the Consent Calendar will be held over to the next meeting unless the City Manager requests action due to priority.

 

1.         Needle Exchange Emergency Distribution

Recommendation: Adopt a Resolution reviewing and confirming the continued existence of a local emergency with regard to HIV transmission from use of HIV-infected needles among injection drug users, and authorizing the Local Health Officer to take steps to enable the operation of needle exchange emergency distribution.

2.         Approval of Revised Minutes

            Recommendation:  Approve minutes as revised by Mayor Dean, for the meetings of:

a) April 17, 2001 (regular); and b) April 24, 2001 (regular).

            Recommendation:  Approve minutes for the meetings of: a) May 8, 2001 (regular); and b) May 8, 2001 (special).

4.         Purchase Order:  Police Equipment and Supplies

            From:  City Manager

Recommendation:  Adopt a Resolution approving a purchase order increase for a total amount not to exceed $41,000 for the purchase of equipment and supplies from Antonio's Uniforms.

5.         Contracts:  Youth Employment Program

            From:  City Manager

            Recommendation:   Adopt a Resolution authorizing the City Manager to execute contracts and any amendments for the period March 1, 2001 to June 30, 2002, with: 1) the Alameda County Workforce Investment Board for administration of the North Cities Consortium’s year-round youth employment program in an amount not to exceed $300,827; and 2) Indigenous Nations Child and Family Agency for administration of the City of Alameda’s year-round youth employment program in an amount not to exceed $85,435.

6.         Contract:  Air Monitoring Study

Recommendation:  
Adopt a Resolution authorizing the City Manager to amend the contract with Applied Measurement Science by increasing the amount $12,300 for a total contract amount not to exceed $52,000, to test the air at Harrison Park for certain metals, and to assess any associated health risks.

7.         Grant Application:  Energy Codes and Standards

Recommendation: 
Adopt a Resolution authorizing the City Manager to submit a grant application with PG&E in an amount not to exceed $90,000 to provide second year funding for technical assistance for energy codes and standards, and execute resultant agreements and any amendments
for the period October 2001 to September 2002.

8.         Donation for Cesar Chavez Park
From:  City Manager
Recommendation:
  Adopt a Resolution accepting a donation of $11,200 from Kazuko and Atsushi Inoue for a memorial bench and pathway improvements in Cesar Chavez Park in memory of Junko Hosoda; and extending the City’s appreciation for this kind and generous donation honoring the life of Junko Hosoda.

9.         Housing Trust Fund Loan:  Prince Hall Arms Project

            From:  City Manager

Recommendation:  Adopt a Resolution conditionally approving a loan not to exceed $2,100,000 from FY2000-2001 Housing Trust Fund monies to the Prince Hall Arms, Inc. Senior Housing Project located at 3132-38 Martin Luther King Jr. Way, and authorizing the City Manager to execute all necessary documents.

10.       Establishing First Source (to be delivered)

Recommendation:  Adopt a Resolution effective June 1, 2001, establishing the First Source Fund for funds from implementation of a one percent allocation from all eligible capital projects to administer any and all aspects of the First Source Employment Program.

11.       Contract:  Low-Income Energy Program Revenues

            From:  City Manager        

Recommendation:  Adopt a Resolution authorizing the City Manager to execute a California Low-Income Home Energy Assistance Program revenue agreement and any amendments with the State Department of Community Services and Development in an amount not to exceed $97,605 for the period June 1, 2001 through August 31, 2001, to provide bill payment assistance and weatherization services to eligible residents of Berkeley, Albany and Emeryville.

12.       Paratransit Taxiscrip Program Improvements

            From:  City Manager        

Recommendation:  1) Adopt a Resolution to: a) allow all taxicab company owners and drivers to accept taxiscrip as payment for a ride in lieu of cash, b) establish a cash-disbursement fund in an amount not to exceed $5,000 to redeem taxiscrip coupons; c) setting a per-ride minimum amount of $5.00 to be reimbursed by the City for all rides paid with taxiscrip, with the difference between the actual fare and $5.00 to be paid by the City, d) direct the City Manager to redeem taxiscrip for full cash value, and e) direct the City Manager to provide a central location at the Finance Department, no later than July 2, 2001, for taxicab owners and drivers to redeem taxiscrip coupons.

13.       Supporting New Voting Equipment

Recommendation:  Send a letter to the Alameda County Board of Supervisors and Registrar of Voters supporting the purchase of new electronic voting equipment and pledging a commitment to contribute Berkeley’s fair share towards a purchase.

14.       Minimizing Permit Fees for Automatic Gas Shut-off Valves

            From:  Councilmember Polly Armstrong

Recommendation:  Set a reduced fee for the City permit for the installation of automatic gas shut-off valves when a contiguous neighborhood agrees to install ten or more in the same time frame, allowing for an inspector to make one trip to the neighborhood.

15.       Repair of Broken Parking Meters

            From:  Councilmember Polly Armstrong

Recommendation:  Ask the City Manager to direct the Parking Enforcement Bureau to stop giving tickets at broken parking meters until the City improves its meter repair system.

16.       Budget Referral:  $15,000 for Rebuilding Together

            From:  Mayor Dean

Recommendation:  Refer to the budget process for funding within the current cycle, a request for $15,000 for Rebuilding Together (formerly Christmas in April) to hire a volunteer coordinator who would work full-time during the organization’s busiest period between January and June.

17.       Traffic Planning Staff

            From:  Mayor Dean

Recommendation:  Waive Council Rules of Procedure, and request the City Manager report back tonight at this meeting, on the status of staffing for the traffic planning/pedestrian safety function in Berkeley, and any specific recommended measures to attract and retain staff for this important function.

18.       Parking Lot Signage on UC Parking Lots

            From:  Mayor Dean

            Recommendation:  Request the City Manager to:  1) coordinate with the University of California on the implementation of parking lot signage on university lots advertising the availability of public parking on evenings and weekends; and 2) develop any City signs and advertising that are required; and 3) report back with a timetable for implementation of the signage program.

19.       Oppose Racial Ignorance Initiative

            From:  Vice Mayor Shirek

            Recommendation:  Oppose the “Racial Ignorance Initiative” the New Campaign Against Civil Rights, planned for the March 2002 California Election Ballot.

20.       Budget Referral:  Earthquake Preparedness Containers

            From:  Councilmember Spring

            Recommendation:  Refer $20,000 to the budget process as a matching grant for the Berkeley Unified School District to purchase earthquake preparedness containers for public schools and neighborhoods.

21.       Landmark Preservation Fees

            From:  Councilmember Worthington

            Recommendation:  Return the application fee for designation under the Landmark Preservation Ordinance for initiation of structures to $50 and initiation of districts to $100.  Also, refund excess charges to those who have applied since the increase of the fee.

22.       Budget Referral:  $5,000 for 2001 Solano Avenue Stroll

            From:  Mayor Dean

            Recommendation:  Refer to the budget process, a request for $5,000 for the Solano Avenue Stroll in September, and approve a request for fee waivers for the event, food and sound; and waive Berkeley Municipal Code (BMC) Section 20.24.040 to allow a banner across Shattuck Avenue.

23.       Civic Center Building Grant Audit

  Request the City Manager implement the recommendations contained in the audit report for the Civic Center Building Grant by September 30, 2001 and report back to Council by October 25, 2001.

25.       Zoning Appeal of Use Permit 99-10000100:  1825 Berkeley Way

a.            Appeal filed by Stephen Wollmer, John D. Niles and Carole E. Newlands, and Sherry Seethaler of the Zoning Adjustments Board decision of November 27, 2000 which approved the following Use Permits:  to allow the construction of a single family dwelling; and to allow a second main building to be located within four feet, eight inches (4'8") of the rear property line where normally the required rear yard setback would be fifteen feet (15').

26.       Extending Residential Permit Parking

            From:  City Manager

Recommendation:  Conduct a public hearing and upon conclusion, adopt a Resolution amending Sections 25E and 25M of Resolution No. 56,508-N.S. by adding a subsection to extend residential permit parking on the north side of Vine Street between Martin Luther King, Jr. Way and Josephine Street, and on both sides of Woolsey Street between 100 feet east of Shattuck Avenue to Wheeler Street; and authorizing the use of $600 from the operating budget of the Public Works Department to cover implementation costs.

27.       Recreation Program Fees

Recommendation:   Conduct a public hearing and upon conclusion, adopt a Resolution amending Sections 4, 5, and 6 of Resolution 59,002-N.S. to increase rental charges for parks, recreation and swim facilities, and fees for recreation programs effective July 1, 2001; and rescinding Resolutions Nos. 59,534-N.S. and 59,535-N.S.
