BERKELEY CITY COUNCIL SPECIAL MEETING

  TUESDAY, JANUARY 30, 2001

 

SUMMARY

 

1.         Roll Call: 7:05 P.M.  All present.

 

2.         Comments from the Public:  Three speakers.

 

3          Berkeley High School Achievement Plan (to be delivered)

            From:  City Manager

Recommendation:  Possible allocation of City funds and in-kind services upon receipt of interim report from City Manager and Council discussion.

Actions:  Moved, seconded (Maio/Breland) to adopt the City Manager's recommendation and allocating $50,000; to refer an additional $50,000 to the midyear budget process and to convene a task force to address the emergency concerns.

 

Moved, seconded carried (Shirek/Hawley; Abstain - Olds) a substitute motion to adopt Resolution No. 60,925-N.S., the City Manager's recommendation, allocating up to $40,000 for the Berkeley Unified School District as an investment in the Berkeley High School Achievement Plan as adopted by the Board of Education; and approving in-kind service contributions of up to an additional $25,000 in City staff and service time.

 

Moved, seconded, carried (Armstrong/Worthington; Abstain - Olds) to refer an additional amount of $60,000 to the midyear budget process.

 

4.         Public Hearing on Extension of Moratorium on Installation of Telecommunications Antennas

            From:  City Manager

Recommendation:  Conduct a public hearing and upon conclusion suspend Council rules to take action to 1) adopt first reading of an ordinance (7/9 vote required) extending the existing moratorium on the installation of wireless telecommunications antennas for cellular and mobile phones and personal communications systems (PCS) for six months; and 2) direct the City Manager to propose a comprehensive set of zoning regulations for the development and installation of such telecommunications facilities to protect and promote the public interest while not unduly restricting their development or unreasonably discriminating among service providers.

Public Testimony:  The Mayor opened the public hearing.  Twenty speakers heard.  Moved, seconded, carried (Shirek/Hawley) to close the public hearing.

 

Actions:  Moved, seconded (Hawley/Olds) to adopt Ordinance B; withdrawn

 

            Moved, seconded, failed (Worthington/Maio; Noes - Armstrong, Hawley, Olds,

            Shirek, Dean) a substitute motion to adopt Ordinance D

 

            Moved, seconded, failed (Hawley/Olds; Noes - Armstrong, Breland, Worthington; Abstain - Dean) to approve Ordinance A as written.

 

            Moved, seconded (Worthington/Breland) a substitute motion to approve Ordinance D with the addition of the addition to Section 3 of the following: "all property within 300 feet of residential property" and to delete Sections E & F.

 

            Moved, seconded, carried (Hawley/Worthington; Noes - Armstrong) to adopt Ordinance No. 6613, (Ordinance B) with the added language in Section 3 Applicability to read:  "This moratorium shall apply to the installation of any wireless telecommunications antennas for cellular and mobile phones and personal communications systems on property other than the public right of way except to the extent such facilities are expressly authorized pursuant to a franchise issued by the City Council pursuant to the City Charter and implementing provisions of the Berkeley Municipal Code and except for the following districts, provided that such antennas shall be prohibited on any property within 300 feet of any legally established residential use.

 

A.        Central Commercial (C-2);

B.      Manufacturing (M);

C.      Mixed Manufacturing (M-M);

D.      Mixed Use Light Industrial (MU-LI)

 

 

5.         Adjournment

 

Action:  Moved, seconded, carried (Maio/Hawley) to extend the meeting past 11:00 p.m. to complete the item.

 

The meeting adjourned at 11:02 p.m. in memory of Bradley Phillip Evans.
