Comments from the City Manager: 

The winners of the Cast for Trash competition are Susan and Roy Bogas who won $500 from the Ecology Center contest for having no recyclables in their trash.

There will be an Art Forum on February 26 at the South Berkeley Senior Center from 7:00 - 9:00 p.m.

Consent Calendar

 

Action:  Moved, seconded, carried (Worthington/Spring) to adopt the Consent Calendar in one motion except as indicated.

 

1.         Minutes for Approval

Recommendation:
  Approve the minutes for Council meeting of January 30, 2001 (special).

Action:  Removed from the Consent Calendar by Mayor Dean and held over to a future meeting.

  

2.         Lease:  Friends of the Public Library (first reading vote 2/13 - unanimous)

            From:  City Manager

            Recommendation:  Adopt second reading of an Ordinance authorizing a lease agreement with Friends of the Berkeley Public Library, a non-profit corporation, at 2433 Channing Way, for $1.00 per month for approximately 1,000 square feet, for retail sales of used books and City memorabilia, a five-year lease with a five-year option, profits from sales to go to the Public Library.

            Action:  Adopted Ordinance No. 6615-N.S.  Effective:  March 22, 2001.

 

3.         Contract:  Director of Planning Search and Selection

            From:  City Manager

Recommendation:  Adopt a Resolution authorizing the City Manager to execute and implement a contract for services with DMG-Maximus, Inc., in an amount not to exceed $25,500 to complete a search and selection process for the Director of Planning.

4.         Purchase Order:  Long Haul Trucks and Possum Belly Trailers

            From:  City Manager

Recommendation:  Adopt a Resolution approving a purchase order for three long haul trucks and three possum belly trailers from Oakland Truck Center in an amount not to exceed $370,000.

Action:  Adopted Resolution No. 60,944-N.S. with a request by Councilmember Maio that staff report on what the City is doing to obtain energy-efficient vehicles.

 

5.         Protection of Subterranean Archaeological Resources

            From:  City Manager

Recommendation:  Refer to the Landmarks Preservation Commission the issue of amending the Landmarks Preservation Ordinance (Berkeley Municipal Code (BMC) Chapter 3.24) to establish explicit rules for the preservation of subterranean archaeological resources; and direct the Commission to provide recommended ordinance amendments to Council within ninety days.

6.         Contract:  Parking Ticket Processing Services

            From:  City Manager

Recommendation:  Adopt a Resolution authorizing the City Manager to execute an amendment to the contract with Clancy Systems by increasing the contract $165,000 to provide parking ticket processing services (hand held computers and other related equipment) for the Parking Enforcement Unit of the Police Department.

Action:  Removed from the Consent Calendar by Councilmember Hawley.  Moved, seconded, carried (Hawley/Worthington) to adopt Resolution No. 60,945-N.S. with a request by Councilmember Hawley that the City Manager investigate whether there are other vendors of these services and if so to go to a competitive bidding process at the end of this contract and a request by Councilmember Spring that the City Manager investigate switching to a computerized system which does not utilize chalking of tires.  Councilmember Worthington also reminded the City Manager of prior requests to remove illegally parked cars from the Derby Street area.

7.         Business Improvement District Ordinance

            From:  City Manager

            Recommendation:  Adopt first reading of an Ordinance establishing supplemental authorization for the formation of property and business improvement districts under the Property and Business Improvement Act of 1994.

            Action:  Adopted first reading of Ordinance.  Second reading February 27, 2001.

 

8.         Eastshore State Park Planning Process

            From:  City Manager

            Recommendation:  Adopt a Resolution designating the Waterfront Commission and the Parks and Recreation Commission as lead commissions to sponsor joint informational meetings with the East Bay Regional Parks District (EBRPD) during preparation of a general plan for the new Eastshore State Park.

9.         Impact of Proposition 21 on Berkeley Young People

            From:  Councilmembers Hawley and Shirek

            Recommendation:  Request the Youth Commission to work with the City Manager and other appropriate community groups to:  1) investigate the impact of Proposition 21 on juveniles and juvenile crime in Berkeley; 2) determine if there are any recently-passed ordinances that have had an unintended negative effect on young people; 3) alert the Council to any inadvertent actions that could potentially involve young people in the criminal justice system; 4) research the crime prevention efforts of Alameda County, particularly in relation to the county program developed through the Schiff-Cardenas Crime Prevention Act of 2000 (AB 1913); and 5) sponsor a community forum to present this information to Council members and the public, and include specific outreach to Berkeley High School students.

10.        Support "Fix California Nursing Homes Now!"

                 From:  Councilmember Worthington

Recommendation:  Adopt a Resolution supporting SEIU California State Council’s Campaign “Fix California Nursing Homes Now!”

11.       Regional Transportation Plan

            From:  Councilmember Worthington

Recommendation:  Refer to the Transportation Commission the Bay Area Transportation and Land Use Coalition’s recommendation to the Regional Transportation Plan.

            Action:  Approved recommendation.

 

12.       Bicycles Parked Against Parking Meters

            From:  Councilmember Worthington

Recommendation:  Amend Berkeley Municipal Code 14.68.180 (Ord. 4957-NS) to allow bicycles to park against parking meters.

            Action:  Held over to the meeting of March 20, 2001 by Councilmember

            Worthington.

 

13.       Increased Protections, Ellis Act

            From:  Councilmembers Spring and Maio

Recommendation:  Refer to the City Attorney an urgent request to draft an ordinance to give tenants increased protections when being evicted due to the Ellis Act and to return to Council with this ordinance as soon as possible.

14.       Midyear Budget Process

            From:  Councilmember Spring

Recommendation:  Refer a request to the budget process for $3,000 for a fund for the non-Councilmembers of the Berkeley Housing Authority Board to pay expenses should they choose to attend conferences having to do with Housing Authority matters.

Removed from the Consent Calendar by Mayor Dean.  The Mayor requested Council consider establishing a fund that any commission member could access for attendance at conferences and for other types of training pertinent to their commission. No action taken.

Moved, seconded, failed (Worthington/Maio; Noes – Armstrong, Breland, Olds, Shirek, Dean) to approve the recommendation as proposed by Councilmember Spring.


15.       IFEU Workshop

            From:  Councilmembers Spring, Worthington and Vice Mayor Shirek

Recommendation:  Amend action of October 24, 2000 on the IFEU contract:  1) cancel the community workshop on the IFEU report proposed for April 2, 2001; and 2) schedule just one presentation by IFEU and that it be before the City Council at the already scheduled time 5:30 p.m. on March 27, 2001 in the Council Chambers.

Recommendation:  Approve the minutes for the meetings of:  a) December 12, 2000 (regular), and b) December 19, 2000 (regular) revised as follows:  a)  December 12:  Item 7 revised by Councilmember Spring, and Item 24 revised by Mayor Dean; b)  December 19:  Items 22, 40, 41, 44, 45 and 49 revised by Mayor Dean, and Items 20 and 26 revised by Councilmember Spring.

17.       Contract:  Public Parking at Berkeley Crossing Project and Preferential Parking Area on Second Street

            From:  City Manager

            Recommendation:  Adopt two Resolution:  1) authorizing the City Manager to execute a contract and any amendments with SPI/4th Street Associates for the provision of public parking in a private parking garage to be constructed at 1608 Fourth Street; and 2) designating a preferential parking zone, establishing hours of effectiveness, and authorizing issuance of parking permits, under the California Vehicle Code, on Second Street from Virginia to Jones Streets.

18.       Equal Benefits Ordinance (CR# 99-35 and 00-20)

            From:  City Manager

            Recommendation:  Direct staff to 1) prepare an Equal Benefits Ordinance based on City Manager recommendations; 2) bring an Equal Benefits Ordinance back to Council no later than April 17, 2001; and 3) approved the necessary funding to support implementation of an Equal Benefits Ordinance.
