Preliminary Matters
Roll Call
Ceremonial Matters: Proclamation declaring March 16th through 22nd as Media Democracy Week.
Comments from the City Manager: The City Manager may make announcements or provide information to the City Council in the form of an oral report. The Council will not take action on such items but may request the City Manager place a report on a future agenda for discussion.
Comments from the Public: A total of 30 minutes is scheduled. Each speaker is limited to a maximum of 3 minutes.
Council Action: The City Council may take action related to any subject listed on the Agenda.
Consent Calendar
The Council will consider removal and addition of items to the Consent Calendar prior to voting on the Consent Calendar. All items remaining on the Consent Calendar will be approved in one motion. Items removed from the Consent Calendar will be held over to the next meeting unless the City Manager requests action due to priority.
1. FY 2003 Appropriations Ordinance Amendment

Recommendation: Adopt first reading of an Ordinance amending the FY 2003 Annual Appropriations Ordinance, Ordinance No. 6693-N.S., for Fiscal Year 2003 based upon recommended re-appropriation of unexpended FY 2002 funding and other adjustments authorized since July 1, 2002, in the amount of $45,547,292.

2. Contract: Americans with Disabilities Act Self-Evaluation

Recommendation: Adopt a Resolution authorizing the City Manager to execute a contract and any amendments with Bruckner Consultants for conducting the Americans with Disabilities Act Title II Self-Evaluation, for the period beginning March 25, 2003, through November 30, 2003, in an amount not to exceed $100,000.

3. Purchase Order: Temporary Employment Services - Apple One

Recommendation: Adopt a Resolution authorizing increasing the purchase order with Apple One Employment Agency for an additional $15,000 in an amount not to exceed $40,000 for temporary staffing for the City Clerk Department during the election season and to provide other web related services.

4. Purchase Order: Temporary Employment Services - Certified Personnel Services

Recommendation: Adopt a Resolution authorizing increasing the purchase order with Certified Personnel Services for an additional $3,000 in an amount not to exceed $28,000 for temporary staffing for the City Clerk Department during the election season and to provide for other support services.

5. Lawrence Berkeley National Laboratory Eco-Passes for Employees (PDF, 162 KB)

Recommendation: Ask the City Manager to write a letter to the Lawrence Berkeley National Laboratory Director requesting that LBNL negotiate with AC Transit to make eco-passes available for their employees.

Recommendation: Send a letter to the AC Transit Board urging the elimination of diesel buses on Cedar Street.

Recommendation: Adopt a Resolution supporting the “precautionary principle” and referring to staff the development and implementation of the Precautionary Principle Program to inform decisions made by the City that have a potential impact on public health, the environment, natural resources, sustainability, and quality of life.

10. Appeals: 2508 –2514 - 2416 Benvenue Avenue (Project 1, Use Permit 01-10000075) and 2500 Benvenue Avenue (Project 2, Use Permit 02-10000021) (This public hearing was continued from January 21, 2003 and February 18, 2003)

Recommendation: 1) Conduct a public hearing to consider the CEQA analysis and Use Permit for a group living accommodation to be added to Project 1 in place of the proposed office floor area; 2) complete the public hearing on the balance of the proposed Use Permits, Projects 1 and 2, that have been appealed; and 3) upon conclusion close the Public Hearings and direct staff to prepare a Resolution relevant to the proposed projects.
