Recommendation: Adopt second reading of an Ordinance amending Berkeley Municipal Code (BMC) sections 13.77.040 and 13.77.050 (Ellis Implementation Ordinance) to include the five year restriction on vacancy rent increases authorized in Section 7060.2 of the Ellis Act and to require notice to be given to extend the date a unit occupied by non-elderly or non-disabled tenant is to be withdrawn from the rental market.
