Roll Call
Ceremonial Matters: In addition to those items listed on the agenda, the Mayor may add additional ceremonial matters.

City Manager Comments: The City Manager may make announcements or provide information to the City Council in the form of an oral report. The Council will not take action on such items but may request the City Manager place a report on a future agenda for discussion.
Public Comment: A total of 30 minutes is scheduled. Each speaker is limited to a maximum of 3 minutes.
Youth Comments: A total of 15 minutes is scheduled. Each speaker is limited to a maximum of 3 minutes.

2. Needle Exchange

Recommendation: Adopt a Resolution reviewing and confirming the continued existence of a local emergency with regard to HIV transmission from use of HIV-Infected Needles among injection drug users, and authorizing the local health officer to take steps to enable the operation of Needle Exchange Emergency Distribution.

6. Classification: Human Resources Manager

Recommendation: Adopt a Resolution amending Resolution No. 61,812–N.S., Classification and Salary Resolution for Unrepresented Employees, to add the classification title and salary range of Human Resources Manager in Representation Unit Z1 (Executive and Confidential Management Employees).

7. Contract: Leadership Development Training

Recommendation: Adopt a Resolution authorizing the City Manager to execute a contract and any amendments with the University of California, UC Davis Extension Program, Business and Technology Department from October 6, 2004 through December 31, 2005, to provide training for the new Leadership Development Program in the amount of $24,500 and approving a waiver under Berkeley Municipal Code (BMC) 12.090.070 (Nuclear Free Berkeley Act).

8. Temporary Appointments

Recommendation: Adopt a Resolution amending Resolution No. 60,776–N.S. to modify Personnel Rule and Regulation 9.06 – Temporary Appointments to allow for requests of extension of temporary employees to be approved by the Personnel Board.

9. Grant and Contract: Alcoholic Beverage Control

Recommendation: Adopt a Resolution authorizing the City Manager to execute a grant contract and any amendments with the State of California in order to accept $50,000 in Department of Alcoholic Beverage Control (ABC) Grant funding and appropriate these funds for the enforcement of laws prohibiting furnishing alcohol to minors, persons under the age of 21 possessing alcohol, as well as other alcohol related crimes.

10. Contract: ABC Security Services

Recommendation: Adopt a Resolution authorizing the City Manager to execute an amendment to the contract with ABC Security Services to add a shift at the Corporation Yard for the period October 1, 2004 to June 30, 2005 at an additional cost not to exceed $31,000 increasing the annual contract to a total amount not to exceed $206, 200.

11. Contract: Tire Service for Fleet Vehicles and Equipment

Recommendation: Adopt a Resolution accepting the bid for tire service for fleet vehicles and equipment and authorizing the City Manager to execute a contract and any amendments to Don’s Tire Service for a total amount not to exceed $40,000 annually for FY 2005, with the option to extend for additional twelve month periods up to a maximum of five years.

12. Franchise Agreement: Non-Exclusive Rubbish Hauling
From: City Manager
Recommendation: Adopt a Resolution declaring intention to grant non-exclusive rubbish collection and transportation franchise for an indeterminate period to Golden Gate Disposal and Recycling Company (GGD&R) and scheduling a Public Hearing on November 16, 2004.

13. Contract: Street-Parking Pay Stations
From: City Manager
Recommendation: Adopt a Resolution authorizing the City Manager to execute a five-year agreement with Cale Parking Systems USA, Inc. (Cale) to: 1) replace 284 single space meters located in the “Southside Pilot Area” with Pay and Display Stations for an initial amount not to exceed $332,460; 2) replace up to 568 additional single space meters for an amount of not to exceed $665,000; and 3) provide a future system expansion plan to convert the enter City into Pay Stations within the next five years for an estimated total amount not to exceed $1,000,000.

14. Ellis Implementation Ordinance (PDF, 2 MB)

Recommendation: Adopt first reading of an Ordinance amending Section 13.77.055 of the Berkeley Municipal Code (BMC), Ellis Implementation Ordinance, to increase the amount of the relocation benefit given to displaced tenants and to include elderly and disabled tenants in the class of tenants who qualify for relocation benefits.

15. Support Alameda County Measure BB: Increase and Extension of Parcel Tax for AC Transit (PDF, 235 KB)

Recommendation: Support Alameda County Measure BB: Increase and Extension of Parcel Tax for AC Transit which, by increasing the existing parcel tax by $2 per month over ten years, will provide a steady stream of funding for AC Transit.

24. Support Proposition 60: Election Rights of Political Parties and Oppose Proposition 62: Elections, Primaries (Held over from September 21, 2004 by Councilmember Worthington)

Action Calendar – New Business
26. Implementation of FY 2005 Adopted Budget/Fire Department

Recommendation: Direct the City Manager to: 1) continue discussions with Berkeley Fire Fighters Association regarding a salary savings at substantially the same percentage impact on total compensation as contributed by other labor unions, equivalent to approximately $300,000 from the Fire Department FY 2005 Budget; 2) provide final recommendations for equivalent reductions (approximately $300,000) to the FY 2005 Budget through the reduction of service in the Fire Department; and 3) reinstate the Fire Department service reduction in FY 2006 should the EMS Tax (Measure M) pass.

27. Voting Delegates - Congress of Cities
