Preliminary Matters

Roll Call: 5:03 p.m.

Present: Councilmembers Anderson, Capitelli, Maio, Moore, Olds, Spring, Wozniak, and Mayor Bates.

Absent: Councilmember Worthington

Public Comment: 2 Speakers.

Closed Session

1. PUBLIC EMPLOYEE APPOINTMENT PURSUANT TO GOVERNMENT CODE SECTION 54957:

Title of position to be filled: City Clerk.

2. CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION PURSUANT TO GOVERNMENT CODE SECTION 54956.9 (c)

The Berkeley City Council will confer with its attorney to discuss whether to file suit against the University of California under the California Environmental Quality, the Alquist-Priolo Act and other laws, to challenge the approval by the Regents of the University of California of the Southeast Campus Integrated Projects Such approval is expected to occur in the same week as this City Council special meeting.

Report from Closed Session: Moved, seconded, carried (Maio/Anderson; Absent – Worthington) to direct the City Attorney to file a suit to stop the Southeast Campus Integrated Projects in the event the Regents certify the EIR and approve the project.

3. CONFERENCE WITH LABOR NEGOTIATOR PURSUANT TO GOVERNMENT CODE SECTION 54957.6:
