Preliminary Matters
Roll Call: 5:05 p.m. All present.
City Manager Comments: The deadline for submitting arguments for or against the measure placing the initiative petition ordinance amending the Landmarks Preservation and Demolition Permit Application for Non-Residential Buildings Ordinances closes on Monday, August 7, 2006 at 12:00 p.m. The deadline for submitting rebuttals to arguments related to this measure closes on Monday, August 14, 2006 at 12:00 p.m.

Action Calendar – Election Matters

Recommendation: Take one of the following actions as provided by Section 92(3 and 4) of
the Charter of the City of Berkeley: 1)
pass the Ordinance without alteration within 20 days after the attachment of
the City Clerk’s certificate of sufficiency to the petition; or 2) adopt a
Resolution submitting the Ordinance without alteration, to a vote of the people
at the November 7, 2006 General Municipal Election after review and comments on
the ballot title and analysis as prepared by the City Attorney.

Action: Moved, seconded, carried (Capitelli/Maio; Noes - Worthington) to adopt Resolution No. 63,417-N.S. (PDF, 1395 KB) submitting the Ordinance without alteration, to a vote of the people at the November 7, 2006 General Municipal Election after review and comments on a revised ballot title and analysis prepared by the City Attorney and presented in the supplemental packet.
Moved, seconded, carried (Maio/Capitelli; Noes – Spring, Olds, Worthington) to approve a revised ballot question presented by the City Attorney in the Supplemental Packet.
Moved, seconded, carried (Capitelli/Maio; Noes – Spring, Olds, Worthington) to approve recommended amendments to the revised City Attorney Analysis, specifically material effect item nos. 1, 5 and 7.
