1.  CONFERENCE WITH LEGAL COUNSEL – EXISTING LITIGATION PURSUANT TO GOVERNMENT CODE SECTION 54956.9(a):

Berkeley Police Association v. City of Berkeley, et al., Alameda County Superior Court Case No. 2002 057569.

 

Action:  M/S/C (Maio/Anderson) to authorize the City Attorney to file an appeal if the Trail Court issues an enforcement order requiring that the complainant be excluded from the complaint investigation process. Ayes – Maio, Moore, Anderson, Spring, Worthington, Bates; Abstain – Wozniak; Absent – Capitelli, Olds.

 

The Police Review Commission meeting adjourned at 6:06 p.m.  The City Council continued in closed session to discuss each of the following matters, not necessarily in the order listed below:

3.  CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION PURSUANT TO GOVERNMENT CODE SECTION 54956.9 (b)(1):

Threatened litigation:

The City Council will discuss with its attorneys the threat of litigation by Verizon Wireless, as set forth in the February 20, 2007, letter from its attorney, Paul Albritton, to the City Council, concerning the denial by the Zoning Adjustments Board of its application to install a wireless telecommunications facility at 2721 Shattuck Avenue, the application of the City’s wireless telecommunications ordinance (BMC Chapter 23C.17) to its application, and the validity of that ordinance.

 

Action:  No reportable action.
