April 19, 2004

  1. Roll Call:      2:33 p.m.

     

    Present:        Councilmembers Maio, Hawley and Mayor Bates.

     

  2. Public Comment: None.

      

  3. Approval of Minutes of Meeting of April 12, 2004 (PDF, 11 KB).

    Action:  Moved, seconded, carried (Maio/Bates; Absent - Hawley) to approve minutes.

     

  4. Review and Action on draft Work Session Agenda for April 27, 2004 (PDF, 13 KB).

    Action:  All items approved for placement on the agenda with the following additions, deletions or changes:

     

    Public Financing of Campaigns for November 2004 Ballot

    a.      From:  Mayor Bates and Councilmember Spring

    Recommendation:  Put before the voters in November 2004 a charter amendment and an amendment to the Berkeley Election Reform Act (BMC 2.12) submitted by the Center for Government Studies to create a voluntary system of full public financing for election campaigns for City offices.

    Contact:  Tom Bates, Mayor, 981-7100; Dona Spring, Councilmember District 4, 981-7140

    Action:  Councilmember Spring’s item amended and to be co-sponsored by the Mayor and Councilmember Spring.  All public financing reports to be included on both the work session and regular meeting agendas.

     

    b.      From: Mayor Bates

    Recommendation:  Support a charter amendment and an amendment to the BERA as proposed by Center for Government Studies with the following amendments:  1a) require that Council affirmatively vote to implement campaign financing for each individual office; 1b) require that the trigger to implement the program be by two-thirds vote of the Council; 2) ask the community and the Fair Campaign Practices Commission (FCPC) to closely examine the number of signatures and small contributions required to qualify for public financing so that this number is set correctly and there be provisions to review and allow for alternations; and 3) include an emergency suspension clause, giving the Council, in the event of a fiscal emergency, the option to suspend the program temporarily.

    Action:  Approved for placement on agenda as a companion to Councilmember Spring’s item.  All public financing reports to be included on both the work session and regular meeting agendas.

     

  5. Review and Action on draft City Council Agenda for April 27, 2004 (PDF, 11 KB).

    Action:  All items approved for placement on the agenda including that all public financing reports are to be included on both the work session and regular meeting agendas.

     

  6. Review and Action on scheduling of Calendar, Public Hearings, Presentations and Work Session topics.

    3. Scheduling Work Session on Creek Ordinance

    Action:  Work session on creek policies scheduled for July 13, 2004 and public hearing scheduled for September 28.

     

  7. Discussion and Action regarding process for review of the Agenda Committee and amendments to Council Rules of Procedure.

    Action: None.

**At its March 11, 2003 meeting, the City Council adopted Resolution No. 61,968-N.S. changing the name of the Rules Committee to the “Agenda Committee” to better reflect its duties.
