granted by the State Department of Transportation (Caltrans) under the
Transportation Enhancement Activities (TEA) Program to fund improvements
at the Berkeley Rail Stop/Transit Plaza; and 2) execute a Contribution
Agreement with Caltrans for the Berkeley Rail Stop/Transit Plaza
improvements.

a Resolution authorizing the City Manager to execute a contract and any
amendments with Ed Roberts Campus (ERC) to assign the City’s option to
the air rights over the eastern parking lot of the Ashby BART station
through May 2007, concurrent with the option agreement between BART and
ERC.

Implications: Loss of value of air rights.

Adopt first reading of Ordinance adding Chapter 12.29 to the Berkeley
Municipal Code (BMC) to establish the Precautionary Principle to guide
decisions that have potential impact on public health, the environment,
natural resources and sustainability and 2) Direct the City Manager to
provide a description, timetable and prioritization by December 2005
regarding areas where the Precautionary Principle will be integrated
into City decision-making.
