1. ALLOCATION OF COMMUNITY DEVELOPMENT BLOCK GRANT,
EMERGENCY SHELTER GRANT FOR FISCAL YEAR
2000-2001, and
3. LANDMARKS DESIGNATION - 801 GRAYSON
1. ALLOCATION OF COMMUNITY DEVELOPMENT BLOCK GRANT, The Berkeley City Council will conduct a public hearing on the following: A. The allocation of approximately $4 million in Community Development Block Grant (CDBG) monies available for housing related activities, improvement of public/community facilities, economic development, and planning and administration. In addition, a total of $139,000 is available for homeless services and facilities under the Emergency Shelter Grant (ESG). Various community based organizations and City projects have submitted proposals for approximately $5.8 million. B. The proposed 5 Year Consolidated Plan for 2000 2005 which will be submitted to the Department of Housing and Urban Development outlining the City's housing and community development program. A
complete set of all proposals received and the Draft Five-Year Consolidated Plan are
available for public review at the Reference Desk of the Public Library at 2121 Allston
Way. The public has until May 5, 2000 to
submit comments before the Consolidated Plan is finalized.

2. DECLARING THE CITY COUNCILS INTENT TO CONSIDER GRANTING A RENEWED FRANCHISE TO METRICOM INC. FOR THE OPERATION AND MAINTENANCE OF A WIRELESS DATA NETWORK; SPECIFYING THE TERMS, CONDITIONS AND CHARACTER OF THE FRANCHISE; AND SETTING FORTH THE NOTICE OF A PUBLIC HEARING WHEREAS, the
City of Berkeley has received an application, accompanied by the appropriate fee, from
Metricom Inc. to renew its franchise to operate and maintain a
wireless data network; and WHEREAS, City staff and
Metricom Inc. have agreed that terms and conditions should be the same as the original
franchise; and WHEREAS, the City
Manager recommends that the Council of the City of Berkeley consider renewing the
franchise for Metricom Inc. based on the terms and conditions specified herein; and WHEREAS, the essential
terms and conditions of the proposed franchise are as follows:
1) A franchise term of up to five years permitting
Metricom to operate, and maintain radio repeaters on selected City street-light poles
owned by the City of Berkeley and located in the public right of way. 2) A franchise fee be levied at 7.5% of Metricom's
gross receipts from subscriptions from business conducted in the City of Berkeley. 3) For the duration of the franchise, Metricom will
loan the City 20 wireless modems and supply 20 free accounts to their wireless data
service. 4) A bond of sufficient size to cover the cost of
removing the radio repeaters from City street-lights, should the company cease operation
or not renew its franchise. WHEREAS, the Council of the City of Berkeley intends to consider the granting of a franchise to Metricom Inc. under these essential terms and conditions; and WHEREAS, pursuant to Berkeley Municipal Code Section 9.60.050, the Council of the City of Berkeley is required to set a public hearing regarding the granting of such franchise, and suggests April 11, 2000, in the City Council Chambers at 2143 Martin Luther King Jr. Way as the date, and location of the public hearing. NOW THEREFORE, BE IT
RESOLVED by the Council of the City of Berkeley that it intends to consider the granting
of a franchise to Metricom Inc. for the operation of a wireless data network, under the
terms and conditions specified herein.
3. LANDMARKS DESIGNATION - 801 GRAYSON The City Council will
hold a public hearing regarding the appeal of the decision of the Landmarks Preservation
Commission designating 801 Grayson Street, Philadelphia Quartz Site, as a Structure of
Merit.
