1.      APPEAL OF ZONING ADJUSTMENTS BOARD DECISION
1861 SOLANO AVENUE

The Berkeley City Council will hold a public hearing regarding the appeal of the decision of the Zoning Adjustments Board to approve a Use Permit under Section 23E.60.030 of the Zoning Ordinance to erect twelve (12) wireless telecommunications antennas on the roof and sides of the Oaks Theater.  Contact Sherry Kelly, City Clerk, 644-6480 for additional information.

2.   APPEAL OF ZONING ADJUSTMENTS BOARD DECISION
2412 PIEDMONT AVENUE

The City Council will hold a public hearing regarding the appeal of the decision of the Zoning Adjustments Board to adopt a resolution declaring the property at 2412 Piedmont Avenue to be a public nuisance pursuant to Section 23B.64.010 of the Berkeley Municipal Code.  Contact Sherry Kelly, City Clerk, 644-6480 for additional information.

3.   2001 LOCAL LAW ENFORCEMENT BLOCK GRANT PROGRAM

The City Council will hold a public hearing to consider using $254,519 in federal funds for the the purpose of funding two patrol officers for a period of two years.  Contact Chief of Police Butler, 644-6568 for additional information.

4.   PROPOSED FILING FEE – RENTAL PROPERTY OWNERS CERTIFICATION OF GAS HEATING APPLIANCES

The City of Berkeley Housing Department is proposing a filing fee charge to owners of tenant-occupied buildings in Berkeley under a new Program (Certification of Gas Heating Appliances Program) which requires certification as to the proper functioning of gas heating appliances in Berkeley’s rental units.

The Program requires rental property owners to have all gas heating appliances and their venting systems evaluated by a licensed mechanical contractor or by a gas/electric utility company every three years.  Newly constructed residential rental units are exempt under this proposal for the first five years following issuance of the Certificate of Occupancy.  Under this Program, property owners will be required to submit compliance documentation to the City of Berkeley and pay a filing fee which is being proposed as follows:

·   With the exception of rooming and lodging house units, rental property owners shall be charged a $12.00 filing fee for each rental unit subject to the certification provision of the Program.

·   Owners of rooming and lodging houses shall be charged a $12.00 filing fee for the first six (6) rooms within a rooming house complex subject to the certification provision of the Program and $2.00 for each additional room.

 

The proposed filing fee is intended to assist the City in recovering the costs to administer the Program.  The proposed fee will generate approximately $50,000 per year in revenue.  For further information, contact Mr. Carlos Romo, Supervising Housing Inspector, at 644-6445.

5.  PROPOSED FEES FOR TELECOMMUNICATIONS CARRIERS SYSTEMS AND EQUIPMENT

The City of Berkeley is proposing to adopt fees for implementation and administration of the City’s new Telecommunications Ordinance.  The proposed fees are intended to recover the costs of administering all aspects of the ordinance.  The ordinance requires that all telecommunications carriers register with the City and provide information about their three-year plan for systems and equipment installation, operation, and maintenance both in the public right-of-way and also on private property within Berkeley.  Subject to various qualifications, the ordinance generally defines a ‘telecommunications carrier’ as the owner of a 'telecommunications system’ that provides ‘telecommunications services’ for a fee. 

 

Those carriers that are determined to be exempt under state and federal telecommunications law will be required to pay only the annual registration fee, ordinance surcharge fee, and permit and inspection fees listed below.  Those carriers not exempt will be required to pay additional compensation to the City for use of the public right-of-way (PROW), per lineal foot.  While this additional compensation is not the subject of this public hearing, it will be presented for Council approval at the same time as the fees described herein.

 

·  Annual Registration Fee:        $3,400

 

  • Ordinance Surcharge Fee:      $1,300 (charged annually for 5 years to recover costs of developing and implementing the ordinance).

  • Permit & Inspection Fee:      $2,000 minimum fee per project.

    • Above eight hours:      

    • +$80 /hr (Ordinance Analyst).

    • +$80 /hr (Engineer).

    • +$80 /hr (Inspector/Environmental Mitigator).

    • +20% of above 8 hour staff cost for Admin.
