INTENTION TO GRANT NON-exclusive rubbish collection and
transportation franchises for aN INDETERMINATE period to the
following applicant companies: bAY vIEW REFUSE SERVICE; BERKELEY
SANITARY SERVICE; BIAGINI WASTE REDUCTION SYSTEMS INC., u.s. eagle,
inc.: and WASTE MANAGEMENT OF ALAMEDA COUNTY, iNC.

FRANCHISE, AND 3) WaivE the COUNCIL rule PROHIBITING COUNCIL ACTION
ON the same night as THE PUBLIC hearing
the City of Berkeley has exclusive authority for collection of
putrescible waste; and
the City of Berkeley allows private haulers to collect rubbish
generated in the City; and
on November 23, 1999, the Berkeley City Council adopted an ordinance
requiring private companies primarily engaged in the collection and
transportation of rubbish generated in Berkeley to enter into
non-exclusive franchise agreements and to pay a franchise fee; and
on November 23, 1999, the Berkeley City Council passed Resolution
No. 60,327-N.S. setting the franchise fee at twenty-six percent of
gross revenues for rubbish collection and transportation services
performed in Berkeley; and
Chapter 9.60 of the Berkeley Municipal Code provides that a
franchise is granted by Ordinance of the City Council after a public
hearing, and that the public hearing date must be set by Council
resolution not less than fifteen nor more than sixty days after the
date of the passage of said resolution; and
the current franchises of the above-listed companies expire on June
30, 2003; and
City staff have reviewed the applications of the above-listed
companies and recommend that those applicants proceed to a hearing.
THEREFORE, BE IT RESOLVED by the Council of the City of Berkeley
that the City Council intends to grant non-exclusive rubbish
collection and transportation franchises for an indeterminate period
to the following applicant companies: Bay View Refuse Service,
Berkeley Sanitary Service, Biagini Waste Reduction Systems, Inc.,
U.S. Eagle, Inc. and Waste Management of Alameda County, Inc.
IT FURTHER RESOLVED, that on Tuesday, the 20th day of
May 2003 the City Council will conduct public hearings on the
question of the granting of each proposed non-exclusive franchise.
The hearings will be held at the meeting place of the City
Council located in the Council Chambers, 2134 Martin Luther King Jr.
Way, Berkeley, California.
IT FURTHER RESOLVED, that the Council waives the Council rule
prohibiting Council action on the same night as the public hearing
for the proposed non-exclusive franchises.
IT FURTHER RESOLVED, that the City Clerk is authorized and directed
to give the notices of hearings required by Section 9.60.050 of the
Berkeley Municipal Code.
