The Department of Planning and Development is
proposing a new “Soft Story
Ordinance” as Chapter 19.39 of the Berkeley Municipal Code. The
proposed ordinance would:
the buildings identified by the City’s survey as containing five
or more residential units and a soft, weak, or open front ground
floor to the City’s official Inventory of Potentially Hazardous
2003 IEBC Chapter A4 with amendments as the standards for the
engineering analysis of seismic deficiencies;
the owner to submit within two years an engineering report to
determine whether the building measures up to the new standards
and, if not, how it can be retrofitted to do so;
for appeals, notice to owners, and owner posting of warning signs
and notification of occupants; and
recording of the notice with the County.
Copies of Chapter A4 are on file with the City
Clerk and are open to public inspection.
The first reading of the ordinance will be at the
regular City Council meeting on October 18, 2005. As required by
Government Code Section 50022.3, a public hearing is scheduled during
the regular City Council meeting on October 25, 2005.
Upon conclusion of the public hearing, the Council may, at its
discretion, hear, approve and adopt a second reading of the ordinance.
