City Council will hold a public hearing to consider the appeal against
a decision by the Zoning Adjustments Board’s approval of Use Permit
#05-10000029, under Berkeley Municipal Code Sections 23E.64.030 and
23E.64.050.B.3 to construct a mixed-use building greater than 20,000
square feet gross floor area and per STATE DENSITY BONUS LAW
(CALIFORNIA GOVERNMENT CODE §65915): 1) To allow a building of more
than four stories (five stories are proposed); and 2) to provide more
market units facing west, higher average floor area for the
market-rate units and an uneven distribution of the Inclusionary units
within the building.
