1. What is the
City of Berkeley Living Wage Ordinance?
|
This
is a City Ordinance that specifies an hourly wage and a health
benefit dollar level applied to certain contracts, agreements
and leases between the City and for-profit and non-profit
entities. It does not apply to every business in the City.

Living Wage take effect?
|
June
21, 2000

3. What are the
dollar limits of the Living Wage?
|
Each
affected employee must receive at least $9.75 per hour and
must receive at least $1.62 cents in health benefits. If no
health benefits are provided, or if health benefits are
provided at less than $1.62, the covered employer must pay the
difference to the employee. Therefore, an employee not
receiving any health benefits would receive an hourly wage of
at least $11.37.

4. Does the
Living Wage specify any other employee benefits?
|
Yes.
It specifies that employees must receive at least 22 days off
annually including vacation and Holidays, and must receive
full pay for at least ten (10) of these days.

5. What
employers are covered by the Berkeley Living Wage Ordinance?
|
The
Living Wage Ordinance covers all entities providing services
to the City of Berkeley through contract or agreement, all
lessees of the City and all entities receiving economic
financial aide from the City. There are certain thresholds of
participation defined for each type of employer as defined
below.

6. What
employees are covered by the Berkeley Living Wage Ordinance?
|
Not
all employees of affected employers are covered by the Living
Wage Ordinance. The Living Wage Ordinance specifies certain
thresholds for participation for employees of covered
employers. These are also defined below.

7. Is anyone
else covered besides the employer and employee?
|
Yes,
all subcontractors used by the employer. The subcontractor is
subject to the same dollar and employee
thresh holds as the primary contractor/employer.

8. Who is not
covered by the City of Berkeley Living Wage Ordinance?
|
Commodity
suppliers) and suppliers of goods (paper, office supplies,
etc. and their employees are not covered. Trainees and intern
positions are not covered.
|

EMPLOYERS
|
|
|
For-profit,
service providers
|
Any for-profit entity providing services
to the City valued at $25,000 cumulative in any 12-month
period; and which has six (6) or more employees.
|
|
Not-for-profit
service providers
|
Any non-profit entity providing services
to the City valued at $100,000 cumulative in any 12-month
period; and which has six (6) or more employees.
|
LESSEES
|
Any lessee of City-owned property,
regardless of amount of rent paid.
|
FINANCIAL AIDE RECIPIENTS
|
Any entity receiving more than $100,000
in City economic financial aide in any 12-month period; and
they are covered by the Ordinance for five (5) years after
receiving said aide.

EMPLOYEES
|
|
|
Of
a for-profit employer
|
Any employee working more than 25% of
their time on the City-contracted services being procured by
the City under the contract with the employer.
|
|
Of
a non-profit employer
|
Any employee working more than 50% of
their time on the City-contracted services being procured by
the City under the contract with the employer.
|
|
Of
a lessee
|
Employees who spend more than 25% of
their working time on the leased premises.
|
|
Of
a City financial aide recipient
|
Employees who spend more than 25% of
their working time on the leased premises.
|
|
Of a subcontractor or a covered
for-profit or non-profit employer
|
Employees who meet the same time-spent
threshold as those of the primary contractor.
